The Unitary Patent and Unified Patent Court

A new system for litigating patents in Europe

The Unified Patent Court (UPC) commenced in June 2023 and introduced a significant change to the enforcement of patents in Europe.

The UPC has exclusive jurisdiction over Unitary Patents (UPs), providing a single forum for European-wide infringement and revocation proceedings. The UPC’s jurisdiction also extends to all traditional European Patents (EPs) already granted by the EPO, unless an opt-out is filed. Opted-out European patents are subject to traditional litigation before each national court. Eventually, once the transitional period for opting out is over, all EPs will be subject to the UPC’s jurisdiction.
